Lifetime Warranty Terms and Conditions

1. Coverage:

• This lifetime warranty ("Warranty") covers defects in materials and workmanship of Borderline Custom Curbing ("Curbing") installed by Borderline Curbing Co. ("Manufacturer").

• The Warranty is valid for the original purchaser of the Curbing for as long as they own the property where the Curbing was installed ("Property").

2. Conditions of Coverage:

• The Curbing must be installed by a professional and according to Manufacturer's installation guidelines.

• Regular maintenance and care must be performed, including but not limited to cleaning and avoiding excessive impact or misuse.

• Any modifications or alterations to the Curbing must be approved by the Manufacturer.

• Proof of purchase and installation may be required to make a warranty claim.

3. Exclusions:

• This Warranty does not cover damage resulting from accidents, misuse, abuse, neglect, natural disasters, or acts of God.

• Damage caused by improper installation, unauthorized modifications, or alterations to the Curbing is not covered.

• Normal wear and tear, including minor cosmetic imperfections, are not covered under this Warranty.

4. Remedies:

• In the event of a defect covered by this Warranty, the Manufacturer will repair or replace the affected portion of the Curbing, at its discretion.

• If repair or replacement is not feasible, the Manufacturer may offer a refund or credit equal to the original purchase price of the Curbing.

5. Transferability:

• This Warranty is non-transferable and applies only to the original purchaser of the Curbing for the duration of their ownership of the Property.

6. Claims Process:

• To make a warranty claim, the original purchaser must contact the Manufacturer and provide proof of purchase, installation, and the nature of the defect.

• The Manufacturer reserves the right to inspect the Curbing in question to verify the claim before proceeding with any remedies.

7. Manufacturer's Responsibility:

• The Manufacturer's sole responsibility under this Warranty shall be limited to repairing, replacing, or refunding the defective Curbing as described herein.

• In no event shall the Manufacturer be liable for any consequential, incidental, or indirect damages arising from the use or inability to use the Curbing.

8. Governing Law:

• This Warranty shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

9. Entire Agreement:

• This Warranty constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.

By purchasing and installing Borderline Custom Curbing, the customer acknowledges and agrees to abide by the terms and conditions of this lifetime warranty.
